1. Eligibility

Participants must:

  • Be 18 years or older.
  • Submit accurate and complete information during application.
  • Have the legal right to operate in their field (e.g., TPDCo licence for drivers, business registration for agents).

2. Acceptance Into the Program

  • Acceptance is not guaranteed. Each application will be reviewed by the El Sol Vida team.
  • Approved applicants will receive a custom qualifying email and, if successful, a digital agreement for e-signature.
  • Upon signing, the affiliate may begin promoting and accessing the system.

3. Commission Structure

  • Hotels & Airbnbs: 15% per verified booking
  • Travel Agents: 15%, increasing to 20% after 50+ bookings/month
  • Bloggers/Influencers: 10%, increasing to 15% after 50+ bookings/month
  • Transportation Providers: 60% payout (includes admission and expenses)

Commission rates are based on net booking value (excluding taxes or OTA platform fees if applicable).

4. Payment Terms

  • Payouts are processed monthly via bank transfer or PayPal, based on completed and verified tours.
  • No payment is made for:
    • Cancelled bookings
    • Chargebacks
    • Fraudulent activity
    • No-shows or refunded reservations

5. Use of Materials & Branding

  • Affiliates may use only the officially supplied El Sol Vida images, booking links, and marketing tools.
  • Misrepresentation of the El Sol Vida brand or unauthorized pricing manipulation may lead to termination.

6. Conduct & Responsibilities

  • Affiliates must provide honest, accurate service to guests or audiences.
  • Transportation Providers must:
    • Have a valid Tourism Product Development Company (TPDCo) Tour Guide Licence
    • Hold vehicle insurance and Transport Authority road licence
    • Maintain a clean, safe, and comfortable vehicle
  • All affiliates must adhere to Jamaican tourism regulations and uphold El Sol Vida’s service standards.

7. Confidentiality

All login credentials, system access, client information, and internal materials shared by El Sol Vida must be kept confidential.

8. Termination

  • Either party may terminate this agreement with written notice.
  • El Sol Vida reserves the right to immediately remove any affiliate who engages in:
    • Fraud
    • Brand abuse
    • Breach of agreement
    • Repeated customer complaints

9. Modifications

El Sol Vida may update these terms at any time. Affiliates will be notified via email or dashboard message and may choose to continue or withdraw from the program.

10. Governing Law

This agreement is governed by the laws of Jamaica. Any disputes shall be resolved under Jamaican jurisdiction.
